Surrogacy involves a woman becoming pregnant and giving birth to a baby on behalf of a couple who wish to have a child but are unable to do so themselves. A surrogate is a woman who carries and gives birth to a baby for the intended parents (known as the commissioning couple). There are two main types of surrogacy:
1. Traditional Surrogacy:
Traditional surrogacy is where the woman carrying the child also uses her own egg. This type of surrogacy is now less common than it once was, for several reasons. IVF has become more mainstream and comparatively more affordable than in the past (traditional surrogates may undergo IUI instead of IVF). Additionally, there have been legal challenges concerning who is recognised as the rightful mother in such cases.
2. Gestational Surrogacy:
Gestational surrogacy refers to an arrangement in which the woman carrying the child has no genetic link to the baby. While some people feel that the term “gestational carrier” is demeaning or impersonal, it is in fact a more accurate description of the role. Although the surrogate is not genetically related to the child, the baby may still be the biological child of one or both intended parents. The use of donor eggs or sperm does not change the definition of gestational surrogacy, but it can lead to complex legal issues if not clearly addressed in the surrogacy agreement, especially as laws vary and may not adequately cover these scenarios.
